Spanish Femdom Mistress Carmen is a rare combination: she is an experienced dominant woman and a lawyer with almost 30 years of professional practice. In this interview, she shares her unique perspective on the legal side of Femdom slave contracts, consent, termination clauses, risks, and misunderstandings that can arise inside and outside the dungeon.

At the same time, she offers a personal look into how her dominance developed within her long marriage and how she and her husband have built a fulfilling Femdom–sub dynamic over the decades. Lady Sas: Dear Carmen, you are a lawyer with around 30 years of experience. That’s why I would like to draw on your extensive legal expertise today to discuss topics such as slave contracts, declarations of intent, and so on in more detail. But first, a question about you as a femdom: How did your dominant tendencies develop and how do you live them out today?

Mistress Carmen: My dominant tendencies developed inside my marriage. We both wanted to extend our sex life to more spiced terrains and started shyly to read and practice about BDSM. With time and confidence, we advanced to more sophisticated practices and role-plays, we love and invent role plays, in public and in private.

My husband was, from the beginning, more inclined to submissive roles and I gradually and naturally assumed the dominant ones, although I must admit that we like to switch roles from time to time. Now I can say, that within our BDSM games I am the mistress and he is my sub, and we couldn’t be happier.

Nevertheless, we keep BDSM separated from our day-to-day marriage. We are both very cooperative people, and we care for the happiness of the couple in a proactive way. The decisions come out automatically after clear exposures, no need to argue. I had to impose my criteria on a fistful of occasions, and I had to admit he was right a few times. All in a natural way.

Sometimes we believe we think the same. It must be the long time together. But perhaps I am stepping out of the question. Just to summarize, I am nowadays and experienced Femdom, self-assured, leading the session in creative ways that even surprises me, I enjoy being in my role and my sub is delighted in his. The years have made me much more efficient and brought us lots of happiness and fulfilment.

I have great respect for my husband and sub because he assumes his role perfectly and I could not be who I am without him. We go by the book, I give great importance to the aftercare even we know perfectly each other. We tried almost every practice; we abandoned some of them because we disliked them and we continued with others that we enjoyed.  

We love to assist to gatherings of people in the community where I proudly present my sub, show his fine-tuned training and I am proud of him, sometimes I lend him, under my supervision, to help inexperienced Femdoms to practice. We have great fun when we attend to sessions with my lesbian friends to whom I lend my sub, I am there like a “voyeur” and I find that exciting.

Femdom Slave Contract Legal

Lady Sas: What is your opinion on slave contracts? Are they necessary and useful, or are they just a nice gimmick?

Mistress Carmen: In my opinion, when you want to play our BDSM games in a responsible way, they are a must because, even if they are not legally enforceable, at least in the west, they are a reasonable proof of an underlying consensual and honest agreement that frames the BDSM actions. They can be helpful in all cases when it is needed to demonstrate that neither of the participants were forced to act in the way they acted.

This may seem only applicable to protect the Femdom but I know about the case of a Domina that suffered a heart attack and died on the spot in the middle of an exhausting session. The police report depicted that the dead could be a case of domestic violence, and the sub was accused. His lawyer used the contract as an important way to prove that they were playing a game strictly within the terms of their agreement, the consents were recent, and the sub was declared innocent.

Lady Sas: How legally binding is a slave contract?

Mistress Carmen: In my opinion is not binding at all due to reasons that range from the Declaration of Human Rights through aspects of local laws that keep you from renouncing to fundamental rights. Nevertheless, as I said in the prior question they are a must because they can be a magnificent tool when it comes to prove intentions, behaviours, consents, limits, etc. Sometimes we tend to believe that our agreement is and will remain confidential but in surprising ways we may find that they come out to light and it is even convenient that they come to light. Besides, when honestly done and followed, there is nothing to be ashamed of.

What points should a good slave contract cover?

Lady Sas: In your opinion, what points should a good slave contract cover? Are there important elements that are often forgotten? For example, is a termination clause necessary?

Mistress Carmen: A termination clause is necessary and very helpful for both parties but let me proceed in order and I’ll come back to the termination clause. Now it would be easy for me to fall into a too detailed and boring explanation. I won’t bore anyone. First, I’ll say that I can provide what would be, for me, an ideal layout of the contract, explained.

For now, I just will say that the contract has to identify as good as possible the two parties and a witness for each party (ideally), that have legal capacity to commit themselves and give her consent to all that is stated in the contract.

Should plainly explain the object of the contract in general, in my opinion stating that it will be an interchange or services between two parties, as conceived in the generally accepted principles of the BDSM as Femdom and Sub. This has to be followed by a list of the main requirements that such a relationship involves and the specifically excluded. Then the conditions stated by each parties, trying not to fall into the unfair clauses which sometimes are easy in these contracts.

I come back to the termination clause: Every contract has to have this kind of clause, because in any human relationship, due to circumstances that can vary from person to person, his/her behaviors can change in ways that affect the spirit of the agreement. Also, the lack of this clause, legally, looks awkward. Therefore, a good contract must mention what will be considered enough to deem the contract as terminated. As an example, I would just mention a cause or termination that, in my opinion, is a typical reason for termination: You have a commitment to be present with your sub in a demonstration. You discussed the details with the sub and he is to show up in a defined way in such and such place at a specified time. He doesn’t show up, he doesn’t inform of any reason for not being as agreed. Clear reason for termination.

Another: The Femdom, repeatedly breeches the boundaries of the sub, she tries to find “smart” ways to make him give his “consent” on the spot. Another reason for termination.
Elements that are often forgotten:

-The maintenance of a fresh consent through all our evolving practices and training paths. Keep in mind that a person that gave his consent yesterday, a month later, could be unable to do it in an informed and responsible way. And without realizing it! I know many cases of that.

Here I propose an easy-to-follow system that provides fresh consent. You will see in my contract sample. I strongly suggest a 90-day period, or the one that better suits your agreement.

-The renewal of the contract that I link with the above point. There is no such thing as an infinite contract and therefore the renewals and the conditions for renewals are to be considered. Please refer to my sample.

-The unfair clauses: These contracts are typically too “one sided”. We must avoid that. Not by diminishing our requirements but compensating them with other concessions to the other party. Also, please refer to my sample.

Lady Sas: Once I have received the sub’s written consent to the contract, do I have to obtain it again regularly in order to have the contract extended? Or is this one signature sufficient for all time

Mistress Carmen: I answered this in the prior question. I insist: The one-time signature, is not sufficient forever. And, yes, it must be obtained regularly, subject to renovation conditions. Please refer to my sample.

Lady Sas: As a mistress, do I have to ask my sub for his consent again and again before sessions, or is it considered tacitly given since he willingly participates in everything?

Mistress Carmen: The answer is no should you have followed my suggestions on maintaining a fresh consent by means of the short term renewals. Also please remember that we are subject to the generally accepted rules of BDSM. Therefore, you may have all in due order but something new comes to your mind just before or during a session, you know you don’t have his consent for that, then your duty is to inform him and obtain his consent verbally. After the session just document this invention together in an appendix to the contract. Appendixes or addenda’s to the contract can be yearly incorporated to the main body of the contract.

Lady Sas: Let’s assume a sub visits a professional dominatrix. He asks for strict training but emphasizes that he does not want any marks from the session. After the session, he still has welts on his buttocks and clear pinch marks on his nipples, which only disappeared after 4 weeks. Can the sub take action against the dominatrix? Can he demand compensation for pain and suffering?

Mistress Carmen: Strictly speaking he could walk out and go to the police asking for a forensic exam. That would lead automatically to a denouncement against the dominatrix. He better have a written agreement of her services because, although verbal agreements are legal in many western countries, they are much more difficult to prove. Nevertheless, it could happen that a judge, regardless of our agreements, could consider the violence unacceptable anyway and condemn the dominatrix.

Lady Sas: Another case. A sub wants to visit a professional dominatrix. She demands a € 100 deposit. The sub pays the deposit, but the appointment does not take place. He demands a refund of the deposit, but the dominatrix refuses. What can the sub do?

Mistress Carmen: Plainly, I would advise him to deem the money as lost. It is public and stated in all Internet pages devoted to these subjects “Do not send money up front. Just pay to the service provider only directly to her/he, right before the service takes place”.

Theoretically a legal action could be undertaken but the cost-benefit for the sub wouldn’t justify it.

Lady Sas: Let’s assume that a sub is injured with a cane during a consensual BDSM session. Is this bodily harm or an accident? How would you describe it, and is it relevant under criminal law? Could you please classify this?

Mistress Carmen: In my opinion, an error can happen and is inevitable in our practices. It will all depend on your attitude at that very moment. When it happened to me, I stopped instantaneously the session. I went directly to the after care, and explained what had happened, while taking care of the wound. The incident was understood as an accident and forgot. Something completely different is this “accident” being repeated, that could lead to the termination clause.

And yes. We shall keep in mind that nowadays, everybody that presents a red ass (or any other part of his anatomy), plenty of welts and a bleeding one to a forensic analysis, can boost a process against you.  The risk is there. That’s why the importance of having the contract we are discussing, fresh consent and a good attitude. I know about these cases, but they happen very seldomly because subs and we are two sides of the same reality and we tend to act honestly.

Is an injury during consensual BDSM considered bodily harm or an accident?

It depends on context. A one-time injury handled with proper aftercare is generally seen as an accident. Repeated or negligent harm could have legal consequences and may violate the contract.
